AFFIDAVIT OF JAMES WHITEHALL

1. On November 3, 1997 I personally visited the Board of Elections and Ethics ("the Board"), and 441 4th Street NW, and filled out an application to vote in the District of Columbia, listing my residence as 1401 N St, NW.

2. At the time my official residence was Apt. No. 707, however, in a rush, and not being the most careful writer in the world, I wrote "Apartment Number 7," mistakenly omitting "07," the last two digits.

3. The gentleman who assisted me, made a photocopy of my application, which he certified with a date stamp. He informed me that I would receive a copy of my Voter's Registration card by mail within two weeks.

4. After more than a month passed and I had still not received my Voter's Registration card. I telephoned the Board to inquire as to my status, and was informed that my card had been sent out, but returned as "undeliverable." During that conversation I learned that the "Apartment Number" on my original application was incorrect.

5. To insure my right to vote, on or about December 8, 1997, accompanied by Ms. Winifred Gallant, who holds the lease on 1401 N Street, NW, Apt. 707, I returned to the Board at 441 4th St, NW., to rectify my error.

6. I first asked the clerk behind the counter if I could speak to the Registrar. While the clerk contacted the Registrar, I took a voter's registration card from the counter and began filing it out to reflect my correct address as Apartment 707.

7. Kathryn Fairley, the Registrar of Voters, invited Ms. Gallant and myself into her office. Ms. Gallant informed Ms. Fairley that she was the leaseholder on Apartment 707, and confirmed that as my official residence.

8. Ms. Fairley called up my record on her computer. I explained that I had mistakenly put "7" instead of "707," and asked her what I should do.

9. Ms. Fairley suggested that I fill out a change of address form, which is a voter registration form with Section 9 completed.

10. I told her that I had already filled out a change of address form, showed her the form in my hand, and asked whether I could give it to her.

11. Ms. Fairley told me to leave the form with the clerk at the counter, which I did.

12. I do not claim the right to vote anywhere outside the District of Columbia.
