On March 5, 2001, Defendant/Appellant Barry Adams filed on his own behalf a motion and memorandum in support of a new trial, citing the discovery of "new evidence.'
The motion is untimely. Defendant's brief on all issues he wishes to raise on appeal is not due until May 15, 2001. Adams, counsel, appointed yesterday after the instant motion was filed, will notify the Court of any matters that may require attention before the briefs are due. The Court will not indulge in piecemeal litigation of this appeal.
Accordingly, IT IS HEREBY ORDERED that Adams' motion for a new trial (dkt # 87) is DENIED without prejudice to submission and argument at a later date.
