Please forgive our delay in writing to you, the only excuse is that we have been involved with our own troubles and solutions. Thomas sent the originals of your papers to your husband's address a couple of days after we received them from you. We have retained copies to study. We asked that your husband contact us but we have not heard from him yet. Thomas studied your papers and has some questions: l. Initially it looks as if you were sentenced to a minimum of eight years, which would have made you eligible for parole in January, l996. Then Steve Kiersh, who it appears was appointed by the court to represent you, filed a Motion for Reduction of Sentence, that was granted, thereby making your parole eligibility date January l8, l994, or six years - less jail time - from your sentencing date of March 28, l988. There is also a letter from you to Mr. Kiersh, dated July 28, l988, expressing appreciation for his assistance. QUESTIONS: Is this evaluation correct? If not, what is my mistake? 2. Your letter to Edward Paylor, dated July 5, l989, ends with a hand-written notation, "I never got any answer about my new face sheet." Yet you also included a face sheet, dated August 29, l989, which appears to reflect that your sentence had been recomputed, in accordance with Judge Morrison's Order of a year earlier (August 29, l988) reducing your minimum from 8 years to 6 years. QUESTIONS: Is there some question as to the validity of the Lexington face sheet of August 29, l989? If "yes," what is the question? 3. From the papers you sent it appears that you rely for new evidence primarily on a letter in which Jose Arevalo asked your forgiveness and expressed a desire to assume full responsibility for the murder. Unless I am mistaken you did not send Mr. Arevalo's original letter, but only a translation. It seems that after you received the letter from Mr. Arevalo, Steve Kiersh made several efforts to contact Mr. Arevalo by and or through his attorney Santha Sonenberg. There is also a Motion to Withdraw as Counsel, filed by Mr. Kiersh on May l5, l989, which mentions letters sent to Mona Asiner. It seems there are some missing links. QUESTIONS: Did anyone ever contact Mr. Arevalo? If "no," why not, and what is Mr. Arevalo's address and ID number. What went wrong between the time you wrote Mr. Kiersh the complimentary letter of July 24, l988 and May l5, l989 when he made the statement that he was "not interested in being evaluated, judged and criticized by Ms. Lopez?" What happened with regard to Mona Asiner? Has she tried to assist you? If "no," why not? 4. QUESTIONS: Have you received any response to your Motion to Vacate Sentence, filed September 7, l989?
