Re:  88-5367 and related cases, Thomas et al v. Canfield et al

Dear Ms. Dupre:

     Please forgive the delay in this follow-up to my letter of
January 2l, l990, in which I requested that you transmit the Record
in Thomas et al v. United States, et al, 88-5367 and related cases,
to the United States Supreme Court.

     As various circumstances and considerations combined in such
a manner as to preclude appellants' petition for Writ of
Certiorari, the transmission of the record to the Supreme Court
would serve no purpose at this time.  Accordingly, appellants
hereby withdraw the request of our earlier letter.

     With apologies for any inconvenience caused by my tardiness,
