PLAINTIFFS' NOTICE TO THE COURT

The plaintiffs hereby notify the Court that on August 26, 1989 the United States Court of Appeals for the District of Columbia Circuit denied rehearing en banc in United States v. Sunrise a/k/a Semple, USDC App. 88-3064 and consolidated cases. See Exhibit 1.

On September 28, 1989 plaintiff (there defendant) Sunrise moved to terminate discussion on the remaining issues in that case. See Exhibit 2.

On October 5, 1989 the Appeals Court granted the motion to terminate. See Exhibit 3.

For the Court's convenience, copies of the decisions in United States v. Picciotto, 875 F.2d 345 (USDC App. May 23, 1988), and United States v. Thomas, 575 A.2d 1296 (D.C. App. April 19, 1988) are - may the trees forgive us - also attached. See Exhibits 4 and 5.
