NOTICE TO THE COURT

The federal defendants hereby notify the Court that on September 26, 1989, the United States Court of Appeals for the District of Columbia Circuit denied rehearing and rehearing en banc in the earlier William Thomas cases. See attached Orders.

The effect of those Orders is a reaffirmation of the Court of Appeals' July 17, 1989 opinion and order summarily affirming Judge Oberdorfer's dismissal of the Thomas cases. Thomas v.
United States, 696 F. Supp. 702 (D.D.C. 1988); Thomas v. News World Communications. 681 F. Supp. 55 (D.D.C. 1988).
