APPELLANTS' MOTION FOR ORAL ARGUMENT

On or about December 3, 1986, William Thomas, Appellant, pro se in the above entitled action, received a letter, dated November 28, 1981, and signed ALAN I. HERMAN. The letter conveyed notice that this case has been placed on the Summary Calendar of this Court for Wednesday, January 28, 1987, at 9:30 A.M.

Appellant is confident the record of this case makes it readily apparent that any variety of circumstances might be proven in support of his claim. Further, he believes, justice would demand that he at least be permitted to Amend his Complaint prior to an unexplained dismissal by the pre-trial judge. Therefore he fully expects this Court may well Summarily Reverse the lower Court without hearing.

However it is not inconceivable that Thomas, unschooled as he is in the framing of legal documents, may have failed to address some aspect of this matter which the Court may consider relevant to a disposition in his favor.

Wherefore appellant moves the Court to Order oral argument in this case only in an eventuality where the Court may perceive any possibility of a question unanswered on the record which may tend to cast doubt on the existence of a valid claim.
