NOTICE OF RELATED CASE
Pursuant to Local Rule 405(b)(3), the United States Attorney
hereby gives notice that this civil action appears to be related
to two other consolidated actions recently dismissed by Judge
Oberdorfer of this Court, in which a motion for reconsideration
is pending and in which plaintiffs recently noticed an appeal.[1]
On September 16, 1988, Judge Oberdorfer dismissed Thomas
v. United States, C.A. No. 84-3552-LFO and Thomas v. Newsworld
Communications, C.A. No. 87-1820-LFO, two consolidated cases
that present a variety of issues concerning regulations for
Lafayette Park and activities of the United States Park Police
concerning the regulations. Plaintiffs moved for reconsideration
of that dismissal on October 17, 1988 [2] and noticed an appeal
on November 9, 1988.
[1 The United States Attorney is not yet authorized to repre-
sent any of the defendants insofar as they are sued in their
individual capacity. In filing this Notice defendants are not
waiving.any defenses available under Fed. R. Civ. P. 12 or other-
wise and immunity from suit is specifically reserved.]
[2 Plaintiffs' motion was thus untimely under Fed. R, Civ.
P. 59(e).]
