EXPEDITED MOTION TO
CANCEL SUMMARY JUDGMENT HEARING
On September 25, 1986 this Court issued an order directing
Magistrate Burnett to hold a hearing on the "motions for summary
judgment," and to write a report of his recommendations on those
motions. Pursuant to 28 USC 636, and Fed. R. Civ. P. 56 (a), (c),
and (e), plaintiffs hereby move the Court to rescind that order, to
replace the Magistrate in any evaluations of this case, and to
focus this litigation on the issues from which it sprang.
Plaintiffs request an expedited ruling on this motion.
The reasons for this motion are more fully set forth in the
accompanying Memorandum of Points and Authorities in Support.
A proposed Order is attached.
