STIPULATION

The following is hereby agreed to and stipulated by all parties:

Mr. Harley would testify that he took the subject Chinon 35 mm camera on June 8, 1984. He took it from under the rear seat of a Park Service truck delivered to him at Haynes Point in connection with his work as a driver for the Park Service. The camera was the only item connected with this case in the truck at the time Mr. Harley took it as the remainder of the subject seized property had been unloaded previously. Mr. Harley did not know of the camera's evidentiary value. Mr. Harley gave the camera to his daughter, and the film within was thrown out and burned with the remains of a crab dinner the Harley's were enjoying.
