ORDERED, that District Defendants' motion is GRANTED and

FURTHER ORDERED, that Counts 12, 13, and 14 are DISMISSED and

FURTHER ORDERED, that Defendants the District of Columbia, the Metropolitan Police Department, and Captain Radzilowski are DISMISSED from this action.
