PLAINTIFFS' MOTION FOR SUMMARY JUDGMENT AND SUGGESTION FOR RULE 11 SANCTIONS

While preparing a Response to Defendants' Reply to Plaintiffs' Opposition to Defendants' Motion to Dismiss, or Alternatively, for Summary Judgment, on the facts and law presented in defendants motion it became apparent that plaintiffs are more likely candidates for summary disposition than defendants.

Hence, plaintiffs respectfully move this Court to enter Summary Judgment in their favor.

A Memorandum in Support and Statement of Genuine Issues of Fact Not in Dispute accompany this Motion.

A proposed Order is attached.
