DEFENDANTS' UNOPPOSED MOTION FOR A THREE DAY ENLARGEMENT OF TIME

Defendants' Respectfully move, pursuant to Fed. R. Civ. P. 6(b), an enlargement of time of three business days, to and including July 20, 1995 within which to file their response to plaintiffs' motion for summary judgment. In support of this motion, defendants state as follows:

Counsel for defendant received service of plaintiff's motion to dismiss on July 10, 1995. On July 11, 1995, counsel received the Order of the Court requiring the filing of a response to the plaintiff's motion by July 17, 1995. Since that time, due to the pressing demands of other work, counsel for defendant has not yet had an opportunity to prepare defendants' response. Therefore, counsel respectfully requests this brief enlargement of time to complete review of plaintiffs' motion and supporting papers and to file a response thereto. This motion is sought in good faith and with no intention to unduly delay these proceedings.

WHEREFORE, defendants respectfully request that the time within which they may file their response to plaintiffs' motion for summary judgment be enlarged up to and including July 20, 1995. Pursuant to Local Rule 108(m), counsel for defendant contacted

plaintiff William Thomas by telephone concerning this requested enlargement, and he indicated his consent to this relief.
